INSTRUCTIONS AND PROCEDURES

FOR

SITE PLAN REVIEW & SPECIAL PERMIT


WHEN IS IT REQUIRED?

Site Plan Review and Special Permit are two separate requirements that often overlap so as to require simultaneous review by the Town of Pompey Planing Board and Zoning Board of Appeals respectively.

REQUIRED


SPECIAL PERMIT:

The uses permitted by and requiring special permit are set forth in THE SCHEDULE LIMITING THE USE OF BUILDINGS AND LAND ANNEXED TO THE CHAPTER 165 OF THE CODE OF THE TOWN OF POMPEY. This schedule is based on the Zoning District in which the property is located. A copy of this schedule is attached for your use. All procedures and review criteria are outlined in Chapter 165 of the Code of The Town of Pompey.


SITE PLAN REVIEW PROCEDURE:

  1. Complete the attached application including supporting documentation as outlined in the application.
  2. Submit the completed application to the Zoning Enforcement Officer for review.
  3. When the Zoning Enforcement Officer determines the application complete, notice shall made of a public hearing in a designated newspaper at least five days prior to the date of the hearing.
  4. Notice of the hearing shall be sent to the applicant at least ten days prior to the hearing date.
  5. A copy of the application shall be sent to the Onondaga County Planning Board if required by General Municipal Law, Section 239-m.
  6. A copy of the application shall also be sent to Town Engineer, State, County or Town Highway Department having jurisdiction of adjacent or proposed highways and other persons or agencies as per his discretion.
  7. At the hearing the Town Planning Board may require such additional information from the applicant as it deems appropriate or necessary to making a decision on the application. Decision giving approval, approval with modifications, or disapproval of the project shall be made within sixty-two days after the hearing.
  8. In the event that the Planning Board determines that an area variance is required by the proposal, the matter will be referred to the Zoning Board of Appeals and the 62 day decision time shall be stayed during the referral.
  9. The time for a decision may be extended by mutual consent of the Planning Board and the Applicant.

REVIEW CRITERIA FOR SITE PLAN REVIEW:

The Planning Board shall apply the following goals and objectives in reviewing each application’s layout and design:

  1. Compatibility of the proposed use with neighboring uses.
  2. Safe and appropriate movement on and off site of vehicles and pedestrians.
  3. Adequacy of fire safety and suppression systems.
  4. Suitability of landscaping, buffering, lighting and hours of operation.
  5. Adequacy of proposed drainage and sewage systems and other infrastructure.
  6. Suitability of proposed signage.
  7. Appropriateness of architectural design and treatment considering neighboring structures.
